The arguments Sell Buy Currency

Have clear arguments that show that the buying and selling currency in this case judged by the law of gold and silver (dinar and dirham) should be done with cash, with no outstanding at all.



Among the legal arguments of The shows will be singer is the Prophet sallallaahu 'alaihi wa sallam:

الذَّهَبُ بِالذَّهَبِ وَالْفِضَّةُ بِالْفِضَّةِ وَالْبُرُّ بِالْبُرِّ وَالشَّعِيرُ بِالشَّعِيرِ وَالتَّمْرُ بِالتَّمْرِ وَالْمِلْحُ بِالْمِلْحِ مِثْلاً بِمِثْلٍ يَدًا بِيَدٍ فَمَنْ زَادَ أَوِ اسْتَزَادَ فَقَدْ أَرْبَى الآخِذُ وَالْمُعْطِى فِيهِ سَوَاءٌ. رواه مسلم

"Gold is sold with gold, silver sold by silver, wheat is sold with grain, sya'ir (a type of wheat) sold by sya'ir, korma sold korma, and salt are sold with salt, (dose / scales) must be equal and cash. Whoever add or ask for extra then he has committed usury, giver and receiver in this case the same. "(Muslim HRS)

Companions Abu Sa'id Al Khudri Allaah 'anhu said that the Prophet sallallaahu' alaihi wa sallam said:

لاَ تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلاَّ مِثْلاً بِمِثْلٍ ، وَلاَ تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ ، وَلاَ تَبِيعُوا الْوَرِقَ بِالْوَرِقِ إِلاَّ مِثْلاً بِمِثْلٍ ، وَلاَ تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ ، وَلاَ تَبِيعُوا مِنْهَا غَائِبًا بِنَاجِزٍ. رواه البخاري ومسلم

"Do not sell gold convertible into gold but equal to equal, and thou shalt not superiority of either of them than others. Thou shalt not sell silver exchanged with silver but equal to equal, and thou shalt not superiority of either of them than others. And thou shalt not sell any of them handed over in cash exchanged with others that are not given in cash. "(Reported by Al-Bukhary and Muslim)

Thus Shari'a teaches us to buy and sell gold, silver and the like of it, the existing currency in our time. Payment must be made by way of cash and cash alias payable in full without any iota.
This law is a law that has been agreed upon by all scholars' in each school of jurisprudence.

The following story may be a proposition that clarify the intent of the cash payments that are intended by the hadiths above.

عَن ْابن شهاب أن مَالِكِ بْنِ أَوْسٍ أَخْبَرَهُ أَنَّهُ الْتَمَسَ صَرْفًا بِمِائَةِ دِينَارٍ ، فَدَعَانِى طَلْحَةُ بْنُ عُبَيْدِ اللَّهِ فَتَرَاوَضْنَا ، حَتَّى اصْطَرَفَ مِنِّى ، فَأَخَذَ الذَّهَبَ يُقَلِّبُهَا فِى يَدِهِ ، ثُمَّ قَالَ حَتَّى يَأْتِىَ خَازِنِى مِنَ الْغَابَةِ ، وَعُمَرُ يَسْمَعُ ذَلِكَ ، فَقَالَ وَاللَّهِ لاَ تُفَارِقُهُ حَتَّى تَأْخُذَ مِنْهُ ، قَالَ رَسُولُ اللَّهِ . صلى الله عليه وسلم . الذَّهَبُ بِالذَّهَبِ رِبًا إِلاَّ هَاءَ وَهَاءَ ، وَالْبُرُّ بِالْبُرِّ رِبًا إِلاَّ هَاءَ وَهَاءَ ، وَالشَّعِيرُ بِالشَّعِيرِ رِبًا إِلاَّ هَاءَ وَهَاءَ ، وَالتَّمْرُ بِالتَّمْرِ رِبًا إِلاَّ هَاءَ وَهَاءَ  . رواه البخاري

Ibn Shihab related that Malik bin Aus bin Al Hadatsan told him that one day he needed to exchange money hundred dinars (gold), then Talhah was called. Furthermore, we also negotiate and he finally approve to exchange my money, and he immediately took my money and with his hands he pondered my dinars. Furthermore Talhah said: I will give money exchange when the treasurer has come from the area of ​​Al Ghabah (a place outside the medina so far +30 KM), and his words were heard by friends Umar (bin Al Khatthab), so she began spontaneously said to me: thou shalt not leave (Talhah) until you actually have received payment. Because the Prophet sallallaahu 'alaihi wa sallam has said: "Gold exchanged for gold is usury except when done this and this alias in cash, exchanged wheat with wheat is usury, except when done this and this alias in cash, sya'ir (one verietas wheat quality is not good-pen) exchanged sya'ir is riba except when done with cash and this alias, korma exchanged with korma is usury, except when done with this alias and cash. "(Bukhari)

In another narration friend Umar bin Al Khattab Allaah 'anhu more forcefully to explain the meaning of cash meant the hadiths above:

لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ وَلَا تَبِيعُوا الْوَرِقِ بِالْوَرِقِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ وَلَا تَبِيعُوا الْوَرِقَ بِالذَّهَبِ أَحَدُهُمَا غَائِبٌ وَالْآخَرُ نَاجِزٌ وَإِنْ اسْتَنْظَرَكَ إِلَى أَنْ يَلِجَ بَيْتَهُ فَلَا تُنْظِرْهُ إِنِّي أَخَافُ عَلَيْكُمْ الرَّمَاءَ وَالرَّمَاءُ هُوَ الرِّبَا رواه مالك والبيهقي

"Do not sell gold convertible into gold but equal to equal, and thou shalt not superiority of either of them than others. Thou shalt not sell silver convertible into gold, one of which was not given in cash while others handed over in cash. And when he asked you waiting for a while until he entered first into the house before he gave up the goods, then do not deign to waiting for him. Truly I fear for you beyond the limits of halal and which is intended to go beyond the limits of halal is usury. "(Reported by Imam Malik and Al Baihaqi)

What I wrote here is the limited knowledge I have, if there is no truth, then it comes only from God, and if something goes wrong then it is of the devil and ignorance myself, so I became beg forgiveness of Allah Ta'ala. Allaah knows best
